Injury Claim
- The accident is investigated; necessary witness statements
are taken and police reports are obtained, if applicable.
- Our office contacts both your insurance company and the
insurance company of the defendant, and will have communication
with them during the length of your medical treatment.
- After your doctor has discharged you from his/her care,
our office will collect and review all of your medical reports
and bills, together with any records of lost earnings.
- The attorney or insurance company for the defendant may
arrange for a physical examination by their physician. This
is called an Independent Medical Exam (“IME”)
is performed at their expense.
- Our office will perform a thorough evaluation of your
case, outlining the strengths and weaknesses and evaluate
the case based upon our experience, the jurisdiction in
which the case would be tried (if it proceeded to trial)
and other legal and non-legal factors. Based on this evaluation,
we will attempt to negotiate an out-of-court settlement,
inform you of the status of these negotiations, and will
supply you with our recommendations. If no settlement can
be achieved, we will then file the necessary papers to proceed
with a lawsuit on your behalf. If a lawsuit is filed, a
hearing date would be set for approximately 9-18 months
from the date suit is filed.
